"Totally Not A Judicial Re*orm Bill Act Amendment Constitutional" Constitutional Amendment Bill

Preamble

Whereas The common consensus between people is that there should be an appeals court of some sort for the purposes of the Judicial Reform;

Whereas The disagreement is on how to make the appeals court;

Be it enacted by the Senate of SimDemocracy:

Article 1 : Amendment

§1. Article 10, §1 of the Constitution shall be amended to read –

“§1. The Inferior Courts shall possess original and appellate jurisdiction of all cases not originating solely within a colony of SimDemocracy.”

§2. Article 10, §3 of the Constitution shall be amended to read –

“§3. Judges of the Inferior Courts shall interpret and apply the laws of SimDemocracy.”

§3. Article 9, §1 of the Constitution shall be amended to read –

“§1. The Courts, consisting of the Supreme Court and such Inferior Courts as provided for by law, shall be the primary judicial body of SimDemocracy and shall represent the interests of the people by wielding judicial authority.”

Explanatory Statement:

This bill adds the possibility of Appellate courts to be established in the future, by allowing the Inferior Courts to have appellate jurisdiction, without making any extensive modifications to the constitutional structure of the judiciary.

Explanatory Notes:

Section 1 of the amendment amends the Inferior Courts section of the Constitution to allow the Inferior Courts to possess appellate jurisdiction over all cases not originating from a colony.
