Section 1: A New Chapter
Article 1: Certification of Autonomy
§1. The following charter establishes the self-governing structure of the Bicamel Republic and maintains the agreements in the Treaty of Exploe. It shall come into effect after being passed by the SimDemocracy senate and being agreed upon by a majority vote in the Bicamel Republic. It shall be the supreme law of the Bicamel Republic, second only to the SimDemocracy Constitution and the Discord Community Guidelines.
§2. The state of SimDemocracy grants the colony of the Bicamel Republic of SimDemocracy the full autonomy to govern itself by the system stated in this charter, including:
- -To enforce the maintenance of rights granted to individuals by the Bill of Rights within the SimDemocracy constitution, which shall be legally binding in the Bicamel Republic.
- -Create its own laws via a legislature.
- -Assert executive authority within the bounds of the territory of the Bicamel Republic via a governor.
- -Establish its own judiciary body handling legal questions and cases within the jurisdiction of the Bicamel Republic (as stated in this charter).
§3. Other than the constitution of SimDemocracy, all SimDemocracy laws shall be nullified in the Bicamel Republic.
§4. All of the laws of the Bicamel Republic, other than the Camel Crimes Act, shall be nullified.
Section 2: The Government Structure
Article 2: The Camel Governor
§1. The executive authority in the Bicamel Republic of SimDemocracy shall be held by the Camel Governor.
§2. The Camel Governor shall have the power and permissions to enforce all laws within the Bicamel Republic Discord server.
§3. The Camel Governor shall also manage the structure and channels in Bicamel Republic Discord Server and facilitation of community events within the Bicamel Republic.
- §3.1. The Camel Governor shall have full authority to establish a border in the Bicamel Republic Discord server and to manage this border, pursuant to any legislation passed by the House of Camels.
§4. The Camel Governor shall have the power to establish an executive structure via the creation of agencies, which shall manage specific sectors of executive duties.
- §4.1. Agencies shall have their own internal structure and procedure, and shall be headed by a director who shall exert executive authority granted to them by the Camel Governor.
§5. The Camel Governor shall manage relations with the core territory of SimDemocracy and the SimDemocracy President, making sure they’re informed of any prevalent issues in the Bicamel Republic.
§6. The Camel Governor may veto legislation passed by the House of Camels, which may be overturned by ⅔ agreement of the House of Camels.
§7. The Camel Governor may grant to any offender convicted of any offence in the Camel Courts, a pardon, free or subject to lawful conditions, or any reprieve or respite, either indefinite or for such period as the Camel Governor may think fit, of the execution of any sentence pronounced on such offender.
§8. The Camel Governor shall serve one month (30 day) terms and be elected through the following process, to be handled by the Election Supervisor of the Bicamel Republic:
- §8.1. A 24-hour-long publicly accessible call-for-candidates shall be made for Camel Governor Candidates within the Bicamel Republic Discord server.
- §8.2. A 24-long-vote for the Camel Governor shall then be held using a fair democratic system.
- §8.3. The Camel Governor may not also be a member of the House of Camels or Camel Courts.
§9. If at any point during a term there is no Camel Governor in office, the House of Camels, with unanimous agreement, must appoint an individual to be the Camel Governor for the remainder of the term.
Article 3: The House of Camels
§1. The legislative power of the Bicamel Republic shall be held by the House of Camels, which shall consist of elected representatives.
§2. The House of Camels shall have the power to pass legislation which shall be enacted in the Bicamel Republic with a majority vote.
- §2.1. The House of Camels shall have the power to set checks on the executive through legislation.
§3. The House of Camels shall decide on a speaker, through a majority agreement, to manage legislative proceedings and establish procedure, who must be a member of the House of Camels.
- §3.1. The Speaker may be removed from the office of the Speaker if a majority of the House of Camels are in agreement.
§4. The House of Camels shall have the power to conduct investigative hearings into the conduct of individuals in the Bicamel Republic’s government, and to compel individuals to speak in these hearings.
- §4.1. The House of Camels shall additionally have the authority to be granted access to any executive documents, barring ones involving ongoing criminal investigations.
§5. The House of Camels shall have the power to appoint a Special Prosecutor, who shall investigate specific misconduct of the Bicamel Republic executive and shall be granted access to all executive channels, chats, and documents involving the conduct in question.
§6. The House of Camels shall have the power to impeach individuals in the government if 2/3 are in agreement. An impeachment must be certified by either a member of the judiciary agreeing misconduct has taken place or through the signatures of 1/5 of the citizens in the Bicamel Republic.
- §6.1. Misconduct shall be defined as taking actions which harm other individuals, violate the law, or neglect the duties which someone’s position demands of them or would be reasonably expected to demand of them.
§7. The number of Representatives in the House of Camels shall be the number of votes for the House of Camels election divided by 4 (always rounding up), with a minimum of 3 Camel Legislators. If less than 3 Camel Legislators exist at any time during a term, the Camel Governor must choose temporary replacements for the vacant spots whom shall serve until the next term.
§8. Representatives in the House of Camels shall serve one month (30 day) terms and be elected through the following process, to be handled by the Election Supervisor of the Bicamel Republic:
- §8.1. A 24-hour-long publicly accessible call-for-candidates shall be made for House of Camels Candidates within the Bicamel Republic Discord server.
- §8.2. A 24-long-vote for the representatives shall then be held using a fair democratic system.
Article 4: The Camel Courts
§1. The judicial power of the Bicamel Republic shall be held by the Camel Courts, which shall consist of two parts: the lower courts and the High Court, and the SimDemocracy Supreme Court.
§2. The lower courts shall have first jurisdiction over civil and criminal cases, and shall have the necessary powers to uphold a fair trial.
§3. The High Court shall have appellate jurisdiction for all criminal and civil cases, and have a higher authority over the lower courts.
- §3.1. Members of the High Court shall have the authority to make additional orders as are necessary to preserve an individual's rights (including issuing writs of habeas corpus).
§4. The High Court shall also have jurisdiction over cases involving the legality of actions and laws of the Bicamel Republic government in regard to this charter and the SimDemocracy Bill of Rights, disagreements between the lower courts, and issues involving inconsistencies in the law.
§5. The High Court shall have 3 members, and each verdict must be agreed upon by a plurality of members of the court.
- §5.1. The High Court may set its own procedure for choosing to hear a case and how the court operates.
§6. The highest judicial authority in the Bicamel Republic shall be the SimDemocracy Supreme Court. Any case which has been ruled on by the Camel Courts may be appealed to the SimDemocracy Supreme Court.
§7. The Camel Courts shall exist under a common law system. Precedent set by a court shall by binding to courts on a lower level. Binding precedent may only be overturned by the level of court which set it if there is a strong legal reason to do so or if the precedent is no longer relevant.
- §7.1. All SimDemocracy Supreme Court precedent shall be binding on the courts of the Bicamel Republic.
- §7.2. All prior Bicamel Republic court precedent shall serve as a persuasive authority for the Camel Courts.
§8. Members of the lower courts and High Court shall be appointed by the Camel Governor and confirmed by a majority vote in the House of Camels, and shall serve until impeachment or resignation.
- §8.1. Members of the Camel Courts may not have any additional government position which would lead to a significant conflict of interest.
Article 5: Court Jurisdiction
§1. Sentences issued by an inferior court of SimDemocracy shall not apply in the Bicamel Republic Discord server unless a Bicamel Republic court determines the criminal action taken place is a violation of Discord Terms of Service and the individual is at risk for violating the law of the Bicamel Republic.
§2. Individuals may not be charged for the same criminal action in the Camel Courts and the Inferior Courts of SimDemocracy, except where otherwise stated in this charter.
§3. The Camel Courts shall have jurisdiction over acts which take place primarily in the Bicamel Republic Discord server, or impact the Bicamel Republic, and shall only have authority to issue punishments and remedies in the Bicamel Republic.
§4. In situations where a case could be tried in both the Bicamel Republic and SimDemocracy courts:
- §4.1. The Bicamel Republic courts shall have first jurisdiction over criminal acts in which more than 50% of the offense was committed in the Bicamel Republic Discord server or the offense impacts the Bicamel Republic more than the federal government of SimDemocracy.
- §4.1.1. In all other cases, or any case in which the federal government of SimDemocracy is impacted more than the Bicamel Republic, the inferior courts of SimDemocracy shall have first jurisdiction over criminal acts.
- §4.1.2. In cases of equal impact, 50% of the offense being committed in each server, or where jurisdiction is unclear, the first court to begin trying a criminal act shall have jurisdiction unless the court waives this.
- §4.2. The Bicamel Republic courts shall have jurisdiction of a civil case only if the parties meet a minimum-contacts standard.
Article 6: Limits on the Power of the Bicamel Republic
§1. The Bicamel Republic shall be bound to the SimDemocracy bill of rights, and the rights within it are granted to the citizens of the Bicamel Republic.
§2. The tau shall be the main currency of the Bicamel Republic and unless expelled, the Bicamel Republic shall be a member of the tauzone.
§3. The Bicamel Republic of SimDemocracy shall not conduct its own foreign affairs with nations or servers, separate from SimDemocracy. This includes that the Bicamel Republic may not enter a treaty, alliance, confederation with or declare war on any foreign entity. SimDemocracy shall manage all affairs with foreign entities involving the Bicamel Republic.
§4. The Bicamel Republic may not establish its own military.
§5. Citizens of the Bicamel Republic shall have the right to say reclaimed slurs if they can prove they are more than likely to be a part of the minority which the slur pertains to, and do not use the slurs in a derogatory manner.
Article 7: Electoral Supervisor
§1. An individual, known as the Electoral Supervisor, shall manage the elections of the Bicamel Republic in accordance with law.
§2. The Bicamel Republic Electoral Supervisor shall be appointed by the Camel Governor and confirmed by a majority vote in the House of Camels. They shall serve until impeachment or resignation.
Article 8: Discord Supervisor
§1. An individual shall be chosen to own the Bicamel Republic Discord server, and make sure it meets the standards of legislation when no higher authority can, who shall be known as the Discord Supervisor.
§2. The Discord Supervisor shall be apolitical and have no other government positions.
§3. The Discord Supervisor shall be appointed by the Camel Governor and approved via a 3/4 majority in public referendum, and serve until resignation or impeachment.
Article 9: Amendments to Charter
§1. This Charter may be amended through a Constituent Referendum and ratification by the SimDemocracy Senate.
§2. A Constituent Referendum must contain the amendments to the Charter which are being proposed.
§3. When the Electoral Supervisor is presented with a petition comprising the signatures of no less than 1/5th of members of the Bicamel Republic, they shall be required to institute a Constituent Referendum.
§4. Constituent Referendums must be conducted in accordance with the law.
§5. Upon approval by a simple majority of voters in the Constituent Referendum, the SimDemocracy Senate may ratify the amendment with a simple majority vote.
