1. Purpose
The DoJ faces organisational hurdles at the moment manifesting in the breakdown of communication, muddied responsibilities and intransparent rank structures. To correct all these issues and set the DoJ on the right path this DO is issued. Where it conflicts with previous DOs, those shall be considered transplanted in those regards.
2. Changes to the Office of Deputy Attorney General
Only one person shall hold the Office of Deputy Attorney General at any given time. The holder of this office needs to be Bar Certified and needs to have proven trial experience. Their duty is to actively assist the Attorney General in the business of the DoJ. For this purpose they shall wield executive authority within the entire Department, second to the AG. They shall hold power to issue orders to any employee of the Department where such orders do not go against the orders of the AG or higher legal authorities. In relation to any external office or body the Deputy Attorney General shall be considered as acting with the authority of the Attorney General except for those cases in which the law or executive orders require the Attorney General to act personally or in which the actions of the Deputy Attorney General contradict standing orders by the AG. The Deputy Attorney General shall have access to all CL3 Material within the DoJ.
3. Senior Positions in the DoJ
The Director of the SDBI and the Director of the State Attorney Office shall hold seniority in their Departments and shall have executive authority to regulate and administer their offices second to the direct authority of the AG and DAG and within statutory and constitutional boundaries. The AG shall seek consultation with the SDBI Director and SAO Director before making any hiring decision within their offices. Both Directors may at any point in time petition the AG to hire new personnel for their offices, to which the AG shall give a response and provide adequate reasoning if denying the petition. The SDBI Director and SAO Director shall have full CL3 Access inside the DoJ. They report directly to the AG.
4. The State Attorney Office (SAO)
The SAO shall be headed by its director. All Attorneys in the SAO shall be divided into Junior State Attorneys and State Attorneys. Attorneys shall be promoted at the Discrection of the Attorney General and the SAO Director based on established principles within the Office, including but not limited to experience in the department and amount of cases taken.
a) Solicitor General
The Solicitor General shall be in charge of representing the State in cases in front of the Supreme Court and the Court of Review. They shall prioritise such cases before other cases. For the purposes of such cases they may draw upon the resources of the Department of Justice. They report directly to the SAO Director. They may take up cases before these courts upon prompting from the respective court to assign a respondent without prior authorisation by the SAO Director. This shall not limit the SAO Directors ability to substitute counsel for a case based on a case to case determination.
b) Interns
Interns in the SAO shall be assigned at least one State Attorney to oversee their internship. The Supervising Attorney shall be responsible for assisting their intern wherever necessary. At the end of the internship they shall assemble a report on the conduct of the intern to be presented to the AG and the Bar Director or the officer of the bar assigned to overseeing legal training.
5. The SDBI
The SDBI Director shall be in charge of the SDBI. This includes the OHS. The OHS Director shall be a SDBI Lieutenant and be the second in command. The SDBI shall be organised into Task force, each Task force being led by a dedicated Lieutenant. The SDBI Director shall be responsible for assigning officers to each Force. For this they shall consider a balanced workload, time zone availability, experience, cooperation and other factors necessary to ensure the smoothest possible operation of the Department. The OHS shall be a separate sub-office of the SDBI and organised as its own Task force. It shall be led by the specially designated OHS Lieutenant. The SDBI Director and SAO Director shall coordinate to ensure each State Attorney is assigned with one SDBI Task force.
a) Duties
SDBI Officers shall be dutybound to investigate every report they receive. Upon receiving a report they shall open an investigation file in the DoJ server. In this file they shall collect all pertaining evidence, forward relevant messages, provide links to relevant filings and note any decisions taken. This includes the decision to ticket and to close a file. Not noting this information shall be a violation of official duties. Where a ticket does not mandate immediate action, the officer shall ping their assigned State Attorneys to get a legal decision on the potential ticketing of a citizen. The State Attorney shall consider the potential legal consequences of the conduct committed and the potential for success of legal action against the user when making the determination if a ticket should be issued. Where none of the assigned State Attorneys can be reached in time and no other member of the SAO is available to provide guidance in time, the Officer shall act on their own and inform the SAO of the action taken as quickly as possible. If a given conduct requires immediate action, the Officer observing the conduct shall be empowered to take immediate preventive action against further harm within the statutory limits. They shall notify their superior officer and their State Attorneys as soon a possible.
b) Limitations
No SDBI Officer may make any decision in violation of the law. No officer may under any circumstances use their powers for any other reason than allowed for by law or in violation of direct orders of their superiors. They may not reveal information they receive through access to logging channels to any other user unless upon receiving a lawful issued subpoena and having received confirmation of that subpoena from DoJ Leadership.
c) Promotions
Any member of the SDBI shall be considered for promotion based on their experience, initiative, ability to cooperate and consideration in the discharge of their duties. Lieutenants shall submit proposals for promotion to the SDBI Director who shall make the final determination in consultation with the Office of the Attorney General. Any member of the SDBI may approach their Task Force Lieutenant and argue why they should be promoted. The Lieutenant shall consider the request and relay it to the SDBI Director along their recommendation. The consideration of this request shall be classified and limited in access to the Office of the Attorney General, the SDBI Director, the other Lieutenants and anyone holding statutory CL4 access.
6. Transparency
All information in the DoJ shall be at all times be available to the Ombudsman as required by law. The assigned SDIOA Liaison to the DoJ shall have a special role with administrator permissions in the DoJ to ensure they have full access to the DoJs files. The entire Department is required to cooperate with any requests for information by the SDIOA.
7. Conflicts of Interest
Every member of the DoJ who has an interest in the outcome of any matter handled within the DoJ or has any other kind of conflict of interest shall divest themselves from the matter to avoid any conflict materialising any bias in the way a case is handled. They shall notify their superior officer of the Conflict who shall make sure they are not assigned to the matter. Where the Attorney General has a conflict, if possible, the matter shall be assigned to the next officer in the line of succession.
