De Ordine Advocatorum Emendatio Constituti

Approved by the Bar Association on 23 August 2025.

Preamble

Whereas the SimDemocracy Bar Association is a fundamental body for the upholding of Justice itself in SimDemocracy and a vital organ for the safeguarding of Law in the best interests of our community,

Whereas the members of the SimDemocracy Bar Association and their restless efforts, as well as admirable commitment represent one of the main reasons why we can enjoy a judicial system that ensures us fairness and a real Justice,

Whereas the members of the SimDemocracy Bar Association should be able to freely determine the organization under which they gathered themselves in order to face the needs they encounter while they continue to pursue these fundamental duties,

Whereas the current dispositions of the Bar Association Constitutions discipline an almost null decisional action of the members of the Bar Association in the regarding of their own institution,

Therefore there is the need to establish a system that consents the members of the Bar Association to determine their own organization freely in the respect of the Senate’s legislative authority,


I, Senator Nf19_1, hereby present this Amendment to the Bar Association Constitution before the People, the Senate and the Bar Association of SimDemocracy, in order to grant to our esteemed lawyers, Judges and Justices the right to organize their own body.

Section I: Right to Petition

§1. The Bar Association Constitution will be amended to add right after §1, Article 5 a new paragraph. The present new paragraph shall be organized as §2 of Article 5 and will read as follows:

§2. A member of the Bar Association may introduce, amend, or repeal bylaws governing the operations of the SDBA by presenting before the Ethics Committee a petition signed by at least four (4) other members of the Bar Association.

§2. The numbering of the paragraphs constituting Article 5 of the Bar Association Constitution shall be reorganized properly in order to adhere to the Amendment hereby presented.

Section II: Constitutional Amendments

§1. The Bar Association Constitution will be amended to add right after Article 8 a new Article. The present new Article shall be titled “Article 9: Constitutional Amendments” and will read as follows:

Article 9: Constitutional Amendments
 §1. The Director of the SimDemocracy Bar Association (SDBA), a group of four (4) members of the Ethics Committee, or a group of at least five (5) members of the Bar Association shall be able to propose amendments to the Bar Association Constitution before the Senate, which must approve or reject them through a simple majority vote within a reasonable time.
 §2. No amendment to the Bar Association Constitution shall be enforced until it is approved by a two-third (⅔) majority vote of the members of the Bar Association in an internal referendum.
  §2.1. If an amendment is not approved by a two-thirds (⅔) majority vote of the members of the Bar Association in an internal referendum, the Senate shall be entitled to pass it regardless with a two-third (⅔) majority vote.

Section III: Implementation

§1. Upon its passage by the Senate, the hereby present Amendment shall be enforced only upon confirmation by a two-thirds (⅔) majority vote of the members of the Bar Association in an internal referendum.
