Preamble
Whereas the senate rules and procedures are far too rigid;
Whereas this rigidity is more of a barrier rather than an enabling mechanism;
Explanatory notes
§1 The senate rules and procedures lack the ability to alter them in a rolling manner.
§2 Overrides can be defined to alter the rules and procedures for when it is necessary or the senate has a particular choice.
§3 In the case of a provision that was overlooked in the overrides for the senate, it will default to the Senate rules and procedures ac.
§4 Overrides can be created and proposed by any senator, being accepted with a super majority (2/3rds).:
§5 Resolutions are non-binding decisions by the senate to decide its course of action, agenda, motive and acts as a communication tool with the whole of the senate and other bodies.
§6 Senatorial orders are binding decisions to order a particular organisation to take a prescribed action. The nature of these actions should ideally be compliant with the constitution.
§7 Similar to bills, a person can petition the supreme court for a judicial review of a senatorial order.
Article 1: Overrides
§1 A senator may propose a set of overrides to the Rules and Procedures Act. This shall constitute a privileged motion.
§2 The vote to adopt the proposed set of overrides shall last for 24 hours or until all senators have voted. A set of overrides shall be accepted if 2/3rds of the votes are in favour of it.
§3 An override is a substitution or addition for a particular provision present in the aforementioned act.
§4 A set of overrides will be in effect until the end of the term of the senate it was passed in, unless specified otherwise in its corresponding vote.
§5 A senate may motion to dismiss a set of overrides at any given time. This will constitute a privileged motion and lead to a vote, lasting 24 hours. If it is passed, said set of overrides will be repealed.
§6 Once a set of overrides are in effect, any provision made will be assumed to reference the version from the override unless stated otherwise.
- 1. In the event that the referenced provision is not present in the set of overrides, the corresponding provision from the Rules and Procedures Act) shall be used.
- 2. In the event that the provision is not in the Senate Rules and Procedures Act, the action is to be considered invalid.
§7 Overrides must be pinned in .senate-announcements.
Article 2: Resolutions
§1 A resolution is a non-binding announcement from the senate or a committee of the senate (as defined by Senate Leadership and Committees Act) to other departments, branches of government, offices, individuals or to the rest of the senate
§2 A resolution shall be adopted if a simple majority (½+1) of votes are in favour of it.
- §1.1. A motion to adopt a resolution shall be a privileged motion.

Article 3: Senatorial order
§1 A senatorial order is a binding order from the whole of the senate to other departments, branches of government, offices, individuals or to a committee of the senate.
§2 A senatorial order may have orders which the senate has been given the power to issue via the constitution and other legislation.
§3 A senatorial order shall be issued if a simple majority (½+1) of votes are in favour of it.
- 1. A motion to issue a senatorial order shall be a privileged motion.
§4 A person may petition for a judicial review with regards to the senatorial order.
Article 4: Title and Implementation
§1 This bill shall be known as the “Elastic Rules and Procedures” and shall be abbreviated as “ERP”.
§2 The bill shall take effect upon its passage and signing by the president or crossing the 72 hour period.
