Preamble
Whereas, consistent interpretation of examples and repeals in SimDemocracy law is paramount to upholding the integrity of the legal system;
Recognizing the assistance of hmquestionable, Ferris and Justice IvyCactus in formulating this Act;
THE SENATE OF SIMDEMOCRACY PROCLAIMS:
Article 1: Examples Clarification
§1. Where an Act includes an example, summary or illustration of the operation of a provision:
- §1.1. the example or illustration is not to be taken as exhaustive; and
- §1.2. if the example or illustration is inconsistent with the provision, the provision prevails.
Article 2: Repeal Clarifications
Repeal of repealing laws
§1. Where any written law repealing in whole or in part any former written law is itself repealed, the last repeal does not revive the written law or the provisions previously repealed, unless words are added reviving that written law or those provisions.
Example: If Law A repeals Law B, and Law A is repealed, Law B is not revived unless it is specifically stated that it is revived.
Repeal of amended law to include amendments
§2. Where any written law which has been amended by any other written law is itself repealed, the repeal is deemed to include the repeal of all written laws or parts of written laws by which the first mentioned written law has been amended.
Summary: If a law that has had amendments to its provisions is repealed, then the amendments are also automatically repealed.
Repeal and substitution
§3. Where a written law repeals wholly or in part any former written law and substitutes other provision therefor, the repealed written law remains in force until the substituted provision comes into operation.
Summary: When a law repeals or amends a provision of another law, the old provision remains in force until the repeal/amendment is signed into law.
Effect of repeal
§4. Where a written law repeals in whole or in part any other written law, then, unless the contrary intention appears, the repeal does not:
- §4.1. revive anything not in force or existing at the time at which the repeal takes effect;
- §4.2. affect the previous operation of any written law so repealed or anything duly done or suffered under any written law so repealed;
Summary: Unless stated otherwise, when a law is repealed, it doesn't revive anything previously invalid or non-existent, nor does it undo past actions or effects that occurred under that law.
