MAJORITY OPINION by Judge ppatpat
(with Judge Brandmal agreeing)
Introduction
[1] The petitioner is requesting a writ of certiorari quashing the arrest warrant of Tie due to “lack of Probable Cause and ordering the release and unbanning of President Tie.”
Considerations
[2] A writ of certiorari is, as per Article 11 of the Constitution, “an order quashing any decision, order, or proceeding of a judicial or quasi-judicial authority found to be without or in excess of jurisdiction or in violation of the principles of natural justice”.
[3] None of the above are made out, as the Judge Hmquestionable was within his jurisdiction to issue an arrest warrant, and such warrant was not issued in violation of the principles of natural justice.
Verdict
[4] The petition is summarily dismissed.
