Preamble

Whereas Restrictions need to be placed on the removal of the Attorney-General to protect the integrity of Justice;

The Senate of SimDemocracy Proclaims:


Integrity of Justice (Protection) Act

An Act to place restrictions on the removal of the Attorney-General.

Section 1: Amendments to Executive Act

§1. The Executive Act 2023 is amended by –

§1.1. Replacing Article 4 §5 with the following:

“§5. All Executive Officers shall serve until resignation, impeachment, or dismissal by the President, except for the Attorney-General, who may not be dismissed except with the approval of a majority of the Senate and the approval of the President.

§5.1. The Attorney-General may still be impeached without approval of the President despite §5.
§5.2. An Executive Officer’s term shall not be considered automatically extinguished on the election of a new President. However, the new President may appoint a new Attorney-General without needing the Senate’s approval to dismiss the previous Attorney-General within the first three (3) days of entering office, after which the Senate’s approval shall be required.”
§1.2. Replacing Article 6 §2 with the following:

“§2. The SDBI shall be led by the SDBI Director.”

Article 1: Transitory Provision

§1. The persons who are currently serving as Attorney-General and SDBI director at the time of passage of this Act shall continue to serve in said position until impeachment, resignation or dismissal in accordance with law.
