Make The Treasurer Official Already Act 2025

Preamble
Whereas, transparency and accountability in fiscal management are the cornerstones of good governance;
Whereas, the rapid expansion of SimDemocracy’s administrative and economic systems necessitates a unified and reliable framework for the receipt, custody, and distribution of public funds;
Whereas, the proper recording and publication of financial activity are vital to maintaining public confidence in the integrity of government institutions;
Whereas, the current structure of the Department of the Treasury, while robust, lacks a formally established statutory office to ensure consistency, impartiality, and transparency in the execution of treasury functions;
Whereas, I wrote the Executive Order 134-01 that established the Office of the Treasurer in January, and it has functioned without change ever since;
Therefore, be it enacted by the Senate of SimDemocracy, in order to strengthen the fiscal integrity of the State, that the Office of the Treasurer shall be formally integrated as a statutory executive office within the Department of the Treasury, charged with maintaining transparent, lawful, and equitable stewardship of the public purse.
Section 1. Short Title
This Act may be cited as the Make The Treasurer Official Already Act, 2025.
Section 2. Amendment to the Executive Departments Act
Article 7, Department of the Treasury, is hereby amended to add the following section:
“§9. The Office of the Treasurer §9.1 Establishment and Authority (a) The Office of the Treasurer shall exist as an Executive Office within the Department of the Treasury. (b) The Treasurer shall be the principal officer overseeing the Office of the Treasurer, appointed by the Secretary of the Treasury with the consent of the President. (c) The Treasurer shall hold a rank and authority equivalent to a Deputy Secretary of the Treasury and shall serve at the pleasure of the President and/or Secretary of the Treasury. (d) The Office of the Treasurer shall operate under statutory authority and may not be abolished except by an Act of the Senate. §9.2 Duties and Responsibilities (a) The Treasurer shall: (1) Keep a fair and accurate record of all monies received and distributed by the Government of SimDemocracy; (2) Oversee and manage payroll operations for all departments and agencies; (3) Process and record all monetary receipts, disbursements, and investments of the State; (4) Advise the Secretary of the Treasury, the President, and the Senate on monetary and fiscal affairs of the State; and (5) Ensure compliance with statutory and executive requirements regarding transparency, accuracy, and fiscal accountability. (b) The Office of the Treasurer shall be responsible for the publication of periodic financial statements, payroll reports, and general expenditure ledgers, except where classified by statute. §9.3 Records and Transparency (a) The Treasurer shall maintain a public ledger of government transactions on an accessible public drive. (b) Each record shall include the date, amount, recipient or source, purpose, and classification status of each transaction. (c) Classified expenditures may be redacted at the Treasurer’s discretion, subject to review by the Secretary of the Treasury or the Senate Finance Committee. (d) Any falsification or negligent maintenance of Treasury records shall constitute administrative misconduct. §9.4 Receipt and Custody of Government Funds (a) The Treasurer shall receive all monies collected by the Government and deposit them into the Treasury accounts. (b) All receipts shall be recorded under the following categories: (1) Income from taxes; (2) Fees, licenses, and permits; (3) Fines or penalties; (4) Disbursements from the Mint or issuance of new Tau; (5) Government investments and dividends; and (6) Voluntary donations to the State. (c) The Treasurer shall acknowledge and record each receipt before redistribution or expenditure. §9.5 Payroll Administration (a) The Treasury shall process payroll for government employees on a weekly basis, no later than Sunday of each week (1) A Fiscal Week shall begin on Monday, and shall end on Sunday. (b) Department Secretaries must submit payroll records, including employee names and pay grades, no later than Friday of that week. (c) Payroll shall be distributed beginning with the lowest pay grade and ending with the highest, with the President being the final government employee paid. (d) Failure by a department to submit records by the deadline shall result in nonpayment for that payroll period, with no retroactive back pay. §9.6 Enforcement and Oversight (a) The Secretary of the Treasury shall retain oversight over the Office of the Treasurer and may issue directives necessary to maintain compliance with statute. (b) The Treasurer shall have the necessary authority, granted by the Secretary and applicable law, to carry out their duties independently. (c) The Senate may request reports or audits from the Office of the Treasurer at any time by majority resolution. §9.7 Relationship to Non-Statutory Orders (a) Any Executive Orders or Departmental Policies establishing or regulating the Office of the Treasurer prior to this Act are hereby incorporated by reference, provided they do not conflict with this statute. (b) In case of conflict, this statute shall take precedence.”
Section 3. Effective Date
This Act shall take effect immediately upon passage and assent.
