Preamble

WHEREAS, the continued evolution of SimDemocracy’s legal framework requires clarity, consistency, and full alignment with the Constitution;

AND WHEREAS, elements of the current Criminal Code and Constitution contain outdated language, structural redundancies, or contradictions that impair enforcement, confuse interpretation, or undermine constitutional rights;

AND WHEREAS, this Senate recognizes its duty to ensure that all criminal and constitutional provisions reflect clear legislative intent, enforceable standards, and respect for due process;

NOW THEREFORE, in pursuit of legal integrity and institutional credibility, the following measures are enacted to correct inconsistencies, modernize legal language, and reaffirm this government’s commitment to a fair, functional, and constitutional rule of law.

NOW THEREFORE, I submit for Senate consideration a legislative package consisting of four targeted reform bills, each focused on clarity, constitutionality, and legal integrity.

1. The SPAM Act 2025 (Sustained Posting Aimed at Manipulation) redefines Article 50 of the Criminal Code to cleanly separate the offense of spamming from the more severe crime of brigading and raiding. This resolves long-standing ambiguity and ensures fairer enforcement.

2. The Religiously Redundant Amendment 2025 eliminates a duplicated reference to “religion” in Article 14 §3 of the Constitution. While minor, this amendment reinforces the standard of precision expected in constitutional language.

3. The Constitutional Consistency Act 2025 repeals Criminal Code Article 61 §3, a provision that directly contradicts Article 7 of the Constitution by permitting retroactive criminal prosecution. This Act restores our full compliance with due process and the rule of law.

Article 1: Repeal of Criminal Code 2020 Article 50

§1. The current text of Article 50 is repealed in its entirety.

Article 2: Replacement: Article 50 (Spamming)

Article 50 — Spamming

§1. A person commits the crime of Spamming if they repeatedly send messages, pings, images, or other forms of communication with the primary purpose of disrupting conversation, overwhelming communication channels, or causing annoyance to others, and do so without genuine intent to participate in good faith.

§2. Spamming may be committed through manual or automated means.

§3. The sentence for Spamming shall be a mute or ban between six (6) hours and one (1) year.

Article 3: Amendment to Article 14 §3 of the Constitution

§1. In Article 14 §3 of the Constitution, the second occurrence of the word “religion” shall be deleted.

§2. Article 14 §3 shall read,

“Protected characteristics shall include, race, religion, sexual orientation, gender identity, national or social origin, ethnicity, age, disability and political beliefs.”

Article 4: Repeal of Criminal Code 2020 Article 61 §3

§1. Article 61 §3 is repealed in its entirety.
