(with Justice Muggy agreeing, Justice TheLittleSparty concurring, and Chud Justice Ed dissenting without opinion)
Introduction
[1] The petitioner seeks a review of the ability of the President to veto the Senate’s overriding of a prior veto, or whether such an action is unconstitutional.
[2] This case was filed as a reference case, despite the question itself being relevant to recent events outside of this court. Given its simplicity and brevity, and the fact that the factually related matter has resolved itself, the court sees it fit to take it up regardless.
What can the President Veto?
[3] The Constitution says that “[t]he President shall have the authority to veto any votes passed by the Senate, with the exception of confirmations, impeachments, internal motions, and constitutional amendments, and veto overrides, within three (3) days of being formally notified by the Speaker of the Senate of their passage.”
[4] The Constitution states clear as day that veto overrides can not be vetoed. This is not a hard question. The court is baffled as to how anyone could have EVER been confused about this.
Verdict
[5] The president does not have the ability to veto veto overrides passed by the Senate.
