Right to Touch Grass Amendment

Preamble

RECOGNIZING
that SimDemocracy can at points become like an addiction which is hard to quit despite one’s earnest desires,
RECOGNIZING
that having a time away from SimDemocracy which is irrevocable could help people with this ailment,
RECOGNIZING
that quitting SimDemocracy should be a right guaranteed by our Constitution,
WHEREAS
the Touch Grass Act 2025 is possibly unconstitutional,
HEREBY
presents the Right to Touch Grass Amendment 2025.

Right to Touch Grass Amendment 2025

Section 1 — Amendments to the Constitution

§1. A new article titled Article 26 — Right to touch grass shall be added to the Constitution, after Article 26 — Prohibition of slavery and forced labor and shall contain the following text:<ref>Clause numbering fixed in post.</ref>

Article 26 — Right to touch grass

§1. Every person shall have the right to remove themselves from SimDemocracy through a mute or ban, for a specified time or indefinitely, through an order made with informed and express consent requesting as such from the relevant authorities as prescribed by law.

§1.1. A person removed from SimDemocracy under such an order has the right to void or alter such an order at any time, except to shorten time which has been specified irrevocable, which shall be carried out with reasonable haste.
§1.2. The order may specify a time, no shorter than one (1) day and no longer than six (6) months, as irrevocable, meaning that the person may not return before the specified time has passed since the execution of order, regardless of other factors. The person must be informed and consent to this fact before the order is executed, otherwise it is void.
§1.3. The order shall designate a contact through which the person can be reached, who may be changed with the consent of the new contact and with notification to the relevant authorities and the person.
§1.3.1. If no contact is designated, one shall be provided by the relevant authorities, unless the removal is shorter than seven (7) days.
§1.4. A person removed from SimDemocracy under such an order may not be compelled to return, unless strictly necessary, nor may legal proceedings be brought against them, unless strictly necessary or where it is shown that the person has removed themselves from SimDemocracy in order to evade justice.
§1.5. Any time limits, in law or otherwise, shall not count while a person is removed from SimDemocracy under such an order.
§1.6. The law shall respect a person’s right to touch grass and shall to a reasonable extent exclude such persons from such penalties as may provoke a person to return to SimDemocracy against their wishes.

§2. Article 25 — Implied rights shall be moved to be placed after Article 27 — Right to revolution.

§3. All articles shall be renumbered to reflect the above changes.

Section 2 — Amendments to the Touch Grass Act 2025

§1. Article 2 §1 of the Touch Grass Act 2025 is amended from:

§1. A person may apply to the SDBI for a Self-Exclusion order, which shall cause them to be banned or muted from the chats from the SimDem discord server for a period of time not exceeding four (4) months.

§1.1. The person must designate a contact, or be provided with a contact by the SDBI, who must be friended to the person on Discord, or be added to a group chat with the user.
§1.1.1. This provision does not apply when the Self Exclusion Order lasts for a period not exceeding 7 days.

§1.2. The person may apply, through their contact, or through contacting any officer of the SDBI, to vary or discontinue the order after they have completed at least half of the order, or a minimum of one (1) day, and the contact, if the application is received through them, must forward the application to the SDBI.

§1.3. The contact must agree before they may be designated as a contact, and may at any time transfer their duties onto another person, with notification to the SDBI, the person on Self-Exclusion Order, and with the agreement of the new person to be designated as a contact.

§1. A person may apply to the SDBI for a Self-Exclusion Order (SEO), which shall cause them to be banned or muted from SimDemocracy for a period of time as specified in the order, or indefinitely.

§1.1. The application may specify a time, no shorter than one (1) day and no longer than six (6) months, as irrevocable, meaning that the person may not return before the specified time has passed since the execution of order, regardless of other factors.
§1.1.1. If a time has been specified as irrevocable, the SDBI must expressly inform the person what this entails and get their consent as to such.

§1.2. The person must designate a contact, or be provided with a contact by the SDBI, who must be friends with the person on Discord, or be added to a group chat with the user, unless the Self-Exclusion Order is shorter than seven (7) days.

§1.3. The contact must consent before being designated as such, and may transfer their duties to another person with their consent, of which the SDBI and the person on the Self-Exclusion Order shall be given notice.

§1.4. The person may apply, through contacting any officer of the SDBI, or through their contact who shall then contact the SDBI on their behalf, to alter or void their Self-Exclusion Order, after which the changes shall be carried out. The person may not alter or void time which has been specified as irrevocable.
