JUDGMENT by Judge Ed
Introduction
[1] The defendant was charged with 2 counts of Making a False Report under Criminal Code Article 22a §1.2.
[2] The defense pleaded guilty to the 2 charges during the trial, and both sides entered mitigating and aggravating factors.
Sentencing
[3] The defense submitted the guilty plea as a mitigating factor, while the prosecution submitted Exhibit 3 from their evidence document, claiming it shows preplanning of the crime and a lack of remorse, as an aggravating factor.
[4] The sentence available for the charges is a ban of at least 1 week per charge. In determining the sentence, the court will consider the factors outlined in the Sentencing Act.
[5] For mitigating factors, the court accepts the defense’s guilty plea as a mitigating factor. The court also accepts premeditation (based on the Exhibit), and lack of remorse (based on the same act being repeated) as aggravating factors.
[6] For the first count, the court imposes a 1 week ban. For the second count, the court imposes a 2 week ban. The terms are to run consecutively to equate a total ban of 3 weeks, or 21 days.
[7] The defendant was arrested on 16 November 2025 and has served 19 days in detention up to the date of judgment. Under Criminal Code Article 4 §8.1, the sentence exceeds two weeks and the time spent in arrest is more than half of the total. The 19 days are deducted from the 21-day term, leaving a remaining sentence of 2 days.
