Better Jurisdiction (BJ) Amendment

Preamble:

This act allows for SimDemocracy to recognize foreign courts and expands the SimDemocracy jurisdiction.

Section 1

The constitutional referendum failed on 15 June 2025.

§1. Article 21 Clause 1 of the Constitution shall be stricken and replaced with:

    §1. Every person shall be entitled to a fair hearing by a competent court in accordance with law.
         §1.1. A foreign court or moderation system may be legally recognized as a competent court via legislation if it doesn't violate someone’s constitutional rights in SimDemocracy. 

Section 2

§1. Article 1 Clause 1 of the Criminal Code 2020 shall be replaced with:

    §1. A person may only be prosecuted for crimes committed in r/SimDemocracy and its associated Discord server or within the jurisdiction of a competent court recognized by SimDemocracy.
         §1.1. This section does not apply if a person acts on behalf of SimDemocracy and is an elected official, or legally represents SimDemocracy.

§2. Article 1 Clause 5 of the Criminal Code 2020 shall be replaced with:

    §5. If a crime, which directly affects SimDemocracy or persons in SimDemocracy or had the potential of doing so, is committed outside of the jurisdiction given in this article, it may be prosecuted regardless, provided the person under prosecution satisfies the principles laid out in §4.
