JUDGMENT by Justice Ed
[1] The court received a petition by Legal Eagle for a writ of Habeas Corpus alleging unlawful detention as they were arrested and no charges were filed within 72 hours in violation of the time limits for warrants and criminal complaints under CPA Article 25 §1(a).
Summary of Events
[2] The defendant was arrested on September 15, 2025 11:22 PM after a warrant was signed by a judge for Harassment, Hate Speech, and TOS violations.
[3] No criminal complaint was filed for the defendant up until this petition was made which exceeds the 72 hours for a complaint to be filed.
Decision
[4] This petition meets the conditions under Article 17 §3.1.
[5] The court however will not be granting this writ citing Article 17 §4 CPA which permits denial even where a writ would otherwise be valid provided there are "valid [exigencies]".
[6] The defendant’s very limited engagement in the server has consisted almost entirely of particularly targeted harassment and hate speech. The court believes this pattern would continue if the defendant were released now, which the court considers a valid exigency to prevent further harassment.
[7] The court orders under Article 17 §4 CPA that the defendant remain detained for an additional 24 hours, after which they must be released if no criminal complaint is filed.
