The Establishment of NationStates Region Act

Whereas; Establishing a ‘region’ for SimDemocracy within the website NationStates would be a way for SimDemocracy to potentially gain users.
Whereas; Establishing such a colony of SimDemocracy requires establishing the way the colony would function.

Article 1: The NationStates Region

§1. SimDemocracy shall establish a ‘region’ for the website [1] .

§1.1. This ‘region’ shall be a colonial territory of SimDemocracy itself, and the jurisdiction of SimDemocracy shall be applied to this ‘region’.

§2. The colony is to ensure the legal rights granted to SimDemocracy users by the Constitution and laws of SimDemocracy the same as if they were within the official Subreddit or Discord of SimDemocracy.

§2.1. A SimDemocracy user is an individual that has either commented or posted on the official Subreddit of SimDemocracy or is a member of the official Discord of SimDemocracy.
<ref name="nsgov">Amended by the NationStates Governorship Amendment</ref>§2.2. An individual who participates or wants to participate within the colony must provide the Governor of the colony with their Reddit username or Discord username (or both usernames if applicable) along with the name of their ‘Nation’ within NationStates.

<ref name="nsgov" />§2.3. The Governor of the colony shall be responsible for verifying that the individual is a SimDemocracy user and for adding their username(s) and ‘Nation’ name to a public registry of all colony members if they are.

§3. Bans from SimDemocracy itself shall constitute a ban from the colony for the amount of time they are banned from the territory of SimDemocracy itself.

§3.1. The courts may make exceptions to this and specify that the user is allowed to stay within the colony while banned from the rest of SimDemocracy unless the crime is particularly serious and the user has been sentenced to a ban for a particularly significant amount of time.

§4. No SimDemocracy user is to be removed from the colony by colonial authorities unless sentenced to a ban from all of SimDemocracy’s territories, without the previously mentioned exceptions being applied to the sentence, or banned specifically from the colony by the courts of SimDemocracy.

§5. The ‘region’ is not to be transformed at any time to a ‘Frontier’ region.

Article 2: The Governor of the NationStates Colony

§1. The Governor of the NationStates Colony (The Governor) shall be the user with the ‘governor’ status within the NationStates ‘region’.

§1.1. The Governor must be a SimDemocracy user.
§1.2. The Governor may simultaneously be of any other office within SimDemocracy except for the Discord Supervisor, the Reddit Supervisor or the Elections Supervisor.

§2. The Governor shall utilise the powers of the ‘governor’ status to properly maintain and lead the colony.

§3. The Governor may remove any user from the colony that is *not* a registered user of SimDemocracy.

§3.1. If a SimDemocracy user is mistakenly removed from the colony, they must be promptly added back to the colony if they have contacted the Governor about the error.
§3.2. If an individual eligible to be considered a SimDemocracy user, who has not registered as a SimDemocracy user within the colony, is removed they must be promptly added back to the colony if they have contacted the Governor about the error and then registered as a SimDemocracy user within the colony.

§4. The Governor is responsible for removing SimDemocracy users that have been banned by the courts of SimDemocracy from the colony, and for adding those SimDemocracy users back to the colony if they want to return after their ban has been completed, and for counter terrorism action compliant with the Counterterrorism and Security Act 2023.

§4.1. The Governor is to report any possible crimes committed by SimDemocracy users within the colony to the authorities of SimDemocracy and must work with any investigation conducted by the SimDemocracy authorities if requested by the SimDemocracy authorities.

§5. The Governor shall be elected every 4 weeks, and elections shall be available for 24 hours.

§5.1. These elections shall use the same voting method used for presidential elections, as is established in the Appendix §4 or other applicable portions of the SimDemocracy Constitution.
§5.2. The Call for Candidates and election process shall be conducted by the Supervisor of Elections or the Electoral Commission in the same manner as for presidential elections, as is established in Article 7 or other applicable portions of the SimDemocracy Constitution.
§5.3. Only members of the NationStates region who have registered with both the Governor and the Department of Voter Registration may vote in these elections.
§5.3.1. The Department of Voter Registration shall be responsible for determining voter eligibility.
§5.4. If the governorship is vacant, a by-election shall be held by the Supervisor of Elections or the Electoral Commission following the normal process for electing the Governor.
§5.4.1. The by-election shall not occur if the vacancy begins within 5 days of voting for the next regular election of the Governor.
§5.4.2. A Call for Candidates may be issued in anticipation of a vacancy if sufficient notice of resignation or removal is provided.
§5.4.3. If the Call for Candidates for a gubernatorial by-election has not been issued in anticipation of a vacancy, the Call for Candidates must be issued within 24 hours of the vacancy being declared.
§5.5. If a Governor deliberately creates an inaccurate public registry of colony members, or refuses to abdicate the governorship to a newly elected Governor, they shall be considered to have committed treason.

§7. The Governor may conduct diplomacy with other NationStates regions or nations, however this must comply with any treaties ratified by the Senate, any foreign policy decisions by the President and the Department of State (which can itself conduct diplomacy with NationStates regions and nations and may issue any reasonable order to the Governor) and any decisions agreed by a popular vote among the colony.

Article 3: Decisions

Article 4: Delegates

§1. Users within the colony that are elected as a ‘delegate’ to the world assembly must act within the world assembly according to SimDemocracy law, including treaties ratified by the Senate, and the foreign policy decisions of the President and the Department of State.
